In the United States, you have to use a trademark before it can be registered, but in most countries that is not the case. However, while you can register a trademark without use, if you do not use it for a certain period of time, the registration can be cancelled.

There are other major differences between U.S. and other countries' trademark laws. In the United States, you must specify the products on which you are using your trademark in detail, but in many countries you can be much broader. Instead of listing t-shirts, sweatshirts and hats, you can simply say clothing.

Types of International Trademark Applications

  • The Community Trademark (CTM): In the European Union, you can obtain an actual trademark registration from the CTM application. You will not have to go to each individual country to make it valid. It will be recognized in all EU countries.
  • The Madrid Protocol Application: A broad international application, companies can file one application that covers multiple countries as long as they have a registration in their home country.
